1. Agreement to Terms
By accessing or using the Palm & Sage website and engaging our estate sale services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use the site or engage our services. We reserve the right to update these terms at any time, and your continued use of the website or services constitutes acceptance of any changes. We will make reasonable efforts to notify existing clients of material changes.
2. Services Description
Palm & Sage provides estate event curation, appraisal, staging, and property clearing services throughout the greater San Diego area and Southern California. Our services include initial consultations, on-site estate assessments, item cataloging and authentication, sale staging, buyer management, and post-sale property clearing. The information presented on this website is intended for general informational purposes and does not constitute a contractual offer. All engagements are formalized through a separate written agreement between the client and Palm & Sage.
3. Client Responsibilities
Clients engaging Palm & Sage for estate sale services agree to provide accurate and complete information about the estate, its contents, and any known conditions affecting the property or items. Clients must ensure that they have legal authority to sell the items in question and that no liens, disputes, or legal claims exist that would prevent the sale. Reasonable access to the property must be provided during agreed assessment, staging, and sale dates. Clients are responsible for securing any items they wish to exclude from the sale prior to our assessment visit.
4. Commission & Payment
Palm & Sage operates on a commission-based pricing model. The specific commission rate, payment schedule, and any additional fees (such as marketing, specialized appraisals, or post-sale clearing) will be outlined in your individual service agreement prior to the start of any work. No fees are charged for initial consultations. Commission is calculated as a percentage of gross sale proceeds and is deducted before disbursement to the client. Payment to clients is issued within the timeframe specified in the service agreement, typically within 14 business days following the conclusion of the sale.
5. Liability
Palm & Sage exercises professional care in handling, appraising, and selling estate items. However, we do not guarantee the sale of any specific item or the achievement of any particular sale price. Appraisals and valuations are professional estimates based on current market conditions and are not guarantees of value. Palm & Sage is not liable for any loss, damage, or depreciation of items beyond what is covered by our standard care obligations, except in cases of proven negligence. Item authentication opinions are provided in good faith but should not be construed as certified authentications unless explicitly stated in writing. This website and its contents are provided on an “as is” basis without warranties of any kind.
6. Dispute Resolution
In the event of any dispute arising from these Terms of Service or the services provided by Palm & Sage, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to mediation in San Diego County, California before proceeding to any other form of dispute resolution. These terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
